Terms & Conditions

These Terms and Conditions govern your use of the yutithaq website and the firm's legal services. They form the basis of the relationship between you and yutithaq. Please read them carefully before making an enquiry or instructing the firm.

Clause 01

Definitions

In these Terms, the following words have the meanings given below:

"Agreement"
These Terms and Conditions together with any engagement letter or client care letter issued by the firm.
"Client"
Any person or entity that instructs the firm to provide legal services.
"Content"
All written materials, legal opinions, submissions, and documents produced by the firm in the course of a matter.
"The Firm"
yutithaq, a legal practice registered in Thailand and operating from 89/2 Sathorn Tai Road, Thung Maha Mek, Sathon, Bangkok 10120.
"Services"
The legal services offered by the firm as described on this website, including Pension Decision Review, Administrative Appeal Drafting, and Court Representation in Pension Matters.
"User"
Any person who accesses or uses this website, whether or not they become a client of the firm.

Clause 02

Acceptance of Terms

By accessing this website or making an enquiry, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you should not use this website or contact the firm for services.

The firm's services are available to persons aged 20 or over (the age of legal majority under Thai law), or to those with the legal capacity to enter into a binding contract. By making an enquiry, you confirm that you meet this requirement.

Where services are provided on behalf of a third party — for example, a family member acting for a pensioner — the person instructing the firm represents that they have authority to do so.

Clause 03

Service Description

The firm offers legal services in connection with pension matters in Thailand. The three principal services are described on the firm's website and in any engagement letter issued at the commencement of a matter. The scope of each service is defined at the point of instruction and is not open-ended.

The firm makes reasonable efforts to ensure the information on this website is accurate and current. However, website content does not constitute legal advice and should not be relied upon as such. Legal advice is provided only through a formal engagement with the firm.

The firm's services are delivered in Bangkok, Thailand. Remote services, including telephone consultations and document preparation for clients outside Bangkok, are available at the firm's discretion.

Clause 04

Client and User Responsibilities

Clients are responsible for providing the firm with accurate, complete, and timely information necessary for the conduct of their matter. The firm cannot be responsible for the quality of its work where instructions or documents provided are incomplete or inaccurate.

Users of this website agree not to:

  • Use the website for any unlawful purpose or in any manner inconsistent with these Terms.

  • Attempt to gain unauthorised access to any part of the website or associated systems.

  • Transmit any material that is harmful, offensive, or infringes the rights of a third party.

  • Use any automated means to access, scrape, or extract content from the website without the firm's prior written consent.

Clause 05

Intellectual Property

All content on this website — including text, design, logos, and layout — is the property of yutithaq and is protected by applicable copyright and intellectual property law. No part of this website may be reproduced, distributed, or modified without the firm's prior written consent.

Written work products produced by the firm in the course of a client matter — such as legal opinions, appeal submissions, and case notes — are produced for the client's use in that matter. The firm retains copyright in such work but grants the client a non-exclusive licence to use the content for the purposes for which it was prepared.

Clause 06

Fees and Payment

The firm's published fees for the three principal services are as follows:

Fees are payable in Thai Baht. Invoices are issued at the commencement of each service stage. Payment is due within fourteen days of the invoice date unless otherwise agreed in writing. For Court Representation, the firm may request an initial payment on account before work commences.

The firm does not offer refunds once work has commenced on a matter, except where a service is not delivered due to circumstances within the firm's control. Any concern about a fee should be raised with the firm in writing within thirty days of the invoice date.

Clause 07

Service-Specific Terms

Pension Decision Review

The Review produces a written note based on the documents provided by the client. Its purpose is to explain and clarify; it does not constitute a formal legal opinion or a recommendation to take any particular course of action. The scope of the Review is limited to the documents provided and does not extend to an investigation of underlying records held by the pension authority.

Administrative Appeal Drafting

The firm prepares the written appeal and manages the administrative correspondence phase on the client's behalf. The client is kept informed of each material development. The outcome of an administrative appeal is determined by the relevant authority and is not within the firm's control. The firm makes no representation about the likely outcome of any appeal.

Court Representation

Court representation covers the preparation and filing of pleadings, coordination with witnesses and experts, and attendance at hearings. The client will be consulted before any significant procedural step is taken. Court timetables and the conduct of proceedings are subject to the court's direction and are outside the firm's control. Disbursements such as court fees and expert witness costs are borne by the client in addition to the firm's service fee.

Clause 09

Limitation of Liability

To the extent permitted by Thai law, the firm's total liability to a client or user for any cause of action arising from these Terms or the provision of services shall not exceed the total fees paid by that client for the specific service to which the claim relates.

The firm shall not be liable for any indirect, consequential, or special loss, including loss of opportunity, loss of income, or reputational damage, whether or not such loss was foreseeable at the time of the engagement.

Nothing in these Terms limits the firm's liability for fraud, wilful misconduct, or professional negligence of a kind that cannot lawfully be excluded.

Clause 10

Indemnification

You agree to indemnify and hold harmless the firm, its partners, and its staff from and against any claims, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the website, or the provision of false or misleading information in connection with a matter.

Clause 11

Termination

A client may terminate an engagement with the firm at any time by giving written notice. Fees for work completed to the date of termination remain due and payable.

The firm may terminate an engagement in circumstances provided for under the professional conduct rules applicable to legal practitioners in Thailand — for example, where a conflict of interest arises, where instructions become unclear or impossible to follow, or where fees remain unpaid for an extended period. In such cases, the firm will give reasonable notice and take reasonable steps to protect the client's interests during any transition.

Clause 12

Dispute Resolution

In the first instance, any concern about the firm's services should be raised directly with the firm in writing. The firm will acknowledge the concern within five working days and aim to resolve it within thirty days.

If a dispute cannot be resolved informally, the parties agree to attempt mediation before commencing formal proceedings. The mediation will be conducted in Bangkok under the auspices of the Thai Arbitration Institute or such other body as the parties agree.

These Terms are governed by the laws of Thailand. Any legal proceedings that cannot be resolved by the above means shall be subject to the exclusive jurisdiction of the courts of Bangkok.

Clause 13

General Provisions

Entire agreement. These Terms, together with any engagement letter, constitute the entire agreement between the firm and the client in relation to the services described and supersede all prior discussions and representations.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.

Waiver. The firm's failure to enforce any right under these Terms on a given occasion does not constitute a waiver of that right.

Assignment. The firm may assign its rights and obligations under these Terms in connection with a restructuring or transfer of the practice. Clients may not assign their rights under these Terms without the firm's consent.

Notices. Formal notices under these Terms should be given in writing to the addresses set out in Clause 15.

Clause 14

Changes to These Terms

The firm may update these Terms from time to time. The revised Terms will be published on this page with an updated effective date. Continued use of the website or the firm's services following a material change constitutes acceptance of the updated Terms. For existing client engagements, changes will not affect the terms agreed at the outset of the matter unless both parties consent in writing.
